In 1993, the Clinton administration proposed a microchip — the Clipper Chip — that would be embedded in consumer phones and encrypt calls using a classified NSA algorithm called Skipjack. The twist: every device would contain a unique key split between two federal escrow agents, either of which could be compelled by law enforcement to hand over their half. Buy a Clipper-equipped phone and your calls were encrypted against everyone except the government.
It never became mandatory. Within a year, AT&T Bell Labs researcher Matt Blaze published a paper demonstrating a flaw in the Law Enforcement Access Field (LEAF) — a mechanism that was supposed to prevent users from bypassing the escrow without breaking encryption. Blaze showed it could be defeated with a modest amount of computational work. By 1996 the proposal was dead.
The arguments used to defeat the Clipper Chip are functionally identical to the arguments used to defeat every subsequent backdoor proposal. Understanding why requires understanding what a "backdoor" actually means in cryptographic terms.
What a Backdoor Is, Mathematically
Strong encryption works by making decryption computationally infeasible for anyone who doesn't hold the key. A backdoor is a mechanism that allows decryption without the primary key — by holding a secondary key, by weakening the algorithm, or by escrowing key material with a third party.
The problem is not political. The problem is that cryptographic mechanisms don't distinguish between authorized and unauthorized users. A secondary key that law enforcement can use is a secondary key that anyone who compromises law enforcement can use. A weakened algorithm is weakened for everyone. An escrow database is a database — one that contains the keys to every encrypted communication in the country and is therefore one of the most attractive targets on earth.
A key escrow system that grants access to legitimate law enforcement is also a key escrow system that grants access to whoever compromises the escrow infrastructure. There is no architectural difference. Security researchers call this the "NOBUS" problem — "nobody but us" — and it has never been credibly solved.
CALEA: The Wiretap Mandate That Followed
The same year the Clipper Chip launched, Congress passed the Communications Assistance for Law Enforcement Act (CALEA). Rather than mandating a specific chip, CALEA required that telephone carriers build intercept capabilities into their infrastructure — essentially legalizing what the Clipper Chip had tried to accomplish through hardware.
CALEA was later expanded by the FCC in 2004 to cover broadband internet and VoIP services. The legal theory was that any service replacing traditional telephony must support lawful intercept. Internet companies and privacy advocates challenged the expansion; courts largely upheld it.
The 2023 Salt Typhoon hack made CALEA's security assumptions visible in the worst possible way. Chinese state-sponsored hackers gained persistent access to the lawful intercept infrastructure of multiple major US telecommunications carriers — the very systems CALEA had mandated. They were able to monitor calls and texts of government officials and others for months. The backdoor required by law became the vector for a foreign intelligence breach.
The "Going Dark" Era
For most of the 2000s, the backdoor debate was relatively quiet. The internet was growing, but most consumer communications ran through services (email, SMS, web browsing) that were accessible to law enforcement through traditional subpoenas served on providers.
That changed as end-to-end encryption became mainstream. Apple's iMessage launched in 2011 with encryption between Apple devices. WhatsApp deployed the Signal Protocol end-to-end in 2016. The FBI, under Director James Comey, began what became known as the "going dark" campaign: a series of congressional testimonies arguing that encryption was preventing law enforcement from accessing communications it had historically been able to obtain.
The most public confrontation was the 2016 San Bernardino case. The FBI sought a court order compelling Apple to create a modified version of iOS that would disable the auto-erase feature on a locked iPhone 5C belonging to one of the attackers. Apple refused, arguing the modified firmware would be a general tool — a backdoor — that could be used against any iPhone once it existed. The FBI ultimately obtained access through a third-party vendor (widely reported to be Cellebrite or a similar firm) and withdrew the court order before a ruling.

EARN IT and the Liability Approach
By the late 2010s, direct mandates for backdoors had proven politically and legally difficult. A different approach emerged: use liability law rather than technical mandates to pressure platforms into weakening encryption.
The EARN IT Act, first introduced in 2020 by Senators Graham and Blumenthal, proposed conditioning Section 230 liability immunity on compliance with "best practices" defined by a government commission. Critics noted that any best practices requiring platforms to scan message contents for illegal material would be functionally incompatible with end-to-end encryption — you cannot scan content you cannot read. The bill has been reintroduced in multiple sessions without passing.
The UK Online Safety Act and Client-Side Scanning
The UK's Online Safety Act, passed in 2023, took the liability approach further. It grants Ofcom the power to require messaging services to use "accredited technology" to detect illegal content — including in private encrypted messages. The technical mechanism implied is client-side scanning: scanning message content on the user's device before it is encrypted, rather than on the server.
Signal's president Meredith Whittaker described the proposal as a backdoor regardless of its framing. WhatsApp's head of policy said the company would accept being blocked in the UK rather than weaken encryption. As of 2026, Ofcom has not yet invoked the powers in a way that has forced an encryption confrontation, but the powers remain on the books.
Client-side scanning solves the server-side access problem by moving surveillance to the device itself — but it does so by introducing a scanning mechanism that can be updated remotely by the service provider, has no user visibility, and could in principle be expanded beyond its original stated scope.
Why the Technical Objections Keep Winning
Every generation of backdoor proposals has encountered the same set of objections from cryptographers and security researchers, and those objections have a strong track record:
- Key management at scale is unsolved. Escrowing unique keys for every device of every person in a country requires an infrastructure of staggering complexity. The more valuable the database, the more attractive the target.
- Foreign platforms won't comply. A US mandate to backdoor encryption doesn't apply to Signal, which is a non-profit; or to European services; or to open-source software compiled outside the US. Mandates create disadvantages for compliant domestic providers while doing nothing about non-compliant alternatives.
- Criminals will route around it. End-to-end encryption is not difficult to implement. Anyone sufficiently motivated can compile and distribute an app that doesn't comply with a backdoor mandate.
- The infrastructure gets hacked. CALEA's intercept infrastructure was compromised by a foreign state actor. Key escrow databases are not a hypothetical target — they are certain targets for intelligence services worldwide.
The warrant canary model and FISA section 702 represent legal frameworks for surveillance that operate above the encryption layer — compelling disclosure of metadata and communications through legal process served on intermediaries. These are effective for non-E2EE services and ineffective for self-hosted or fully decentralized E2EE. The policy debate has never resolved this gap; it cycles.
Where the Debate Stands
There is no stable resolution in sight. Law enforcement's concerns about encrypted platforms hosting illegal content are genuine and documented. Cryptographers' concerns about backdoor security are equally genuine and better documented. The two positions are structurally incompatible: strong encryption that excludes law enforcement excludes all unauthorized parties; weak encryption that admits law enforcement admits all unauthorized parties.
The most honest framing is that this is a values question masquerading as a technical question. Society must decide how much privacy it is willing to trade for law enforcement access — and that decision has real costs in both directions. What isn't honest is claiming that a technically secure backdoor is possible. Thirty years of proposals, and no one has produced one.
